you have to wonder how things could have played out a bit differently for children’s mother. she and her four children were returning home from a long weekend at disneylandwhen a stranger sexually assaulted her in a secluded area behind a french restaurant. a six-year police investigation into cases like this inevitably smacks of failure. after all, the same would-be attack happened in 1979, two years after it was charged that a man raped a 10-year-old in midtown (police did not investigate that case in 1979 because he did not fit the stereotypical type of rapist. instead, he was an older man with “political power”).

the team of detectives assigned to the case told police that they thought they had a suspect. “they had a ton of proof and they knew who it was“. yet as suspect was arrested on an unrelated charge, police forgot about the case. consequently, the rape kit sat untouched, never tested until after grant, then in prison on a separate rape charge, was sexually assaulting women in a maximum-security prison.

wilkerson and other detectives had their doubts about the victim, and therefore did not submit her rape kit for testing. when the fbi entered the case, detectives and prosecutors asked her to submit another kit, which was also not tested because of a red flag: she repeatedly downplayed the rape and made statements that appeared defensive and reticent.

the case could have been much more complex: the victim had a child at home at the time of the rape and gave birth a few days later. she was taking anti-seizure medication at the time of the rape and had a long-running mental illness

in the mid-1970s, the mpd established a special investigative unit devoted to sex crimes. but almost immediately, the unit was disbanded. det. wilkerson and his squadmates were told to handle all sex crimes themselves.
coupled with a lack of resources, there was little incentive for mpd officers to apprehend suspected rapists. frequently, cases were lost because of the lack of follow-up. a case may have been assigned to a detective, but he or she may have a dozen other cases to juggle. victims and witnesses were often reluctant to testify.
when wilkerson arrived at the crime scene, the apartment was a shambles. the victim had been stabbed multiple times in the throat and chest. the knife had to be removed surgically, and the wounds turned septic.
the city has not agreed to the hack, but city solicitor dean blount has repeatedly assured ybos that he intends to fulfill his commitment to hand over the files, which he concedes are very similar to files he already gave to the women. he promised the city would preserve the data and its privacy protections, but he acknowledged that the data is not easily searchable in the visionrms database. the attorneys also promised to turn over the information by oct. 31.
the women’s attorneys say the fiasco shows the city’s transparency is “the equivalent of a plea bargain,” in which it would go to trial on negligence and reckless conduct claims and accept a $100,000 payout.
but the city is in no hurry to pay the women, saying it could not provide a detailed estimate of the cost. it argues that even if the records contain evidence of police misconduct, the damage can be repaired through a better computer system.
